Licensing and compliance
Under Chapter 6 of the Nature Conservation Act 2014 (the Act) it is an offence to conduct activities in relation to native species (flora and fauna). However, some activities may be carried out under a licence issued by the Conservator of Flora and Fauna. It is the responsibility of the applicant to apply for licences for proposed activities that may be an offence under the Act.
The Parks and Conservation Service (PCS) administers the Act to protect, conserve and enhance the biodiversity of the ACT. Conservation Officers appointed under the Act conduct compliance activities including public education, inspections, audits and investigations to promote and support compliance. PCS has implemented a modern risk-based regulation model and undertakes proportionate and graduated response to non-compliance.
