Update 14 October 2011

  • The Environment Protection Authority (EPA) issued an Environment Protection Order (EPO) to the Authorisation holder on 27 September 2011 in response to the fire on 15 September 2011.  The EPO requires the Authorisation holder to undertake the following: 
  1. Cease the receipt or storage of any further waste at the premises.
  2. Take all steps necessary to disconnect the Premises from the stormwater system.
  3. Take all steps necessary to stop all pollution emanating, or which has emanated, from the Premises.
  4. The premises and any off-site impacts, including surface and ground water, must be assessed for contamination and the contamination remediated by a suitably qualified environmental consultant in accordance with the ACT Environment Protection Authority (EPA), Contaminated Sites Environment Protection Policy, 2009 and associated guidelines.
  5. Prior to undertaking any remedial works a Remedial Action Plan (RAP) must be submitted by the environmental consultant for EPA review and endorsement.
  6. No material is to be removed from Blocks 15 and 16, Section 22, Mitchell ACT without permission from the Environment Protection Authority.
  7. Compliance with this EPO is subject to any Notice served under the Work Safety Act 2008.
  • The EPA met with ESI representatives and environmental consultants engaged by ESI on Friday 14 October 2011 to discuss site assessment and remediation and waste disposal issues for material from the site.
  • The responsibility for any environmental cleanup (under the Act and any Environmental Authorisation) would fall to the Authorisation holder.
